The Steading Terms and Conditions
Booking Confirmation and Payment
1(a) The signing of the booking form constitutes acceptance of these terms by the Holidaymaker and a
binding contract is formed between the owners of Yates Estates and the Holidaymaker. The
booking conditions will also apply if the booking form has not been completed, for example if a
late booking is made by telephone.
1(b) Once this binding contract exists, the Holidaymaker will be responsible for the full rental costs.
1(c) A non-refundable deposit of 20% of the total holiday rental cost is payable upon booking.
1(d) Bookings made within six weeks of the holiday date will require full payment at that time.
1(e) Following the receipt of a completed booking form or telephone booking, and appropriate deposit
payment to Yates Estates, confirmation of the reservation will be sent to the Holidaymaker.
1(f) The balance of the total holiday cost is payable six weeks prior to the start of the holiday. The
Holidaymaker will be reminded at this time. However, where Yates Estates have not received the
balance three weeks prior to the holiday, Yates Estates reserves the right to cancel the holiday
booking and to retain the deposit paid by the Holidaymaker. In such circumstances, the
Holidaymaker will have no claim against Yates Estates for compensation or reimbursement
whatsoever.
1(g) The price of the accommodation includes the following: oil fired-central heating, electricity, an
initial supply of logs, provision of bed and table linen, bath mat, tea towel and cleaning costs.
The following are available to hire at an extra cost: Set of bath and hand towel @ £5 per person
per week, extra logs @ £5 per basket.
Changes by the Holidaymaker
2) Upon receipt of the holiday confirmation letter, the Holidaymaker should immediately check the
details and notify Yates Estates of any amendments as soon as possible.
Cancellation by the Holidaymaker
3(a) The Holidaymaker should notify Yates Estates immediately and in writing of any intention to
cancel the booking. Cancellation will take effect only when Yates Estates receive the notification
letter.
3(b) If the Holidaymaker cancels after the booking is confirmed, the full amount of rent is still payable,
unless the property can be re-let. We therefore strongly recommend holiday insurance.
3(c) If we are able to re-let your accommodation (and we shall make every effort to do so) all monies
paid will be refunded, less the deposit.
3(d) If we are unable to re-let the property for the period of the cancelled holiday, all monies paid by
the Holidaymaker to Yates Estates will be forfeited to Yates Estates.
3(e) No monies will be refunded on cancelled Short Break holidays, whether or not the
accommodation is re-let.
Changes or Cancellation by Yates Estates
4) Whenever possible, the Holidaymaker will be advised of all changes without delay. Should
circumstances beyond our control require us to cancel a booking, Yates Estates will, where
possible, make alternative arrangements. Should these prove unacceptable and once instructions
have been received in writing from you, all monies paid will be refunded but there shall be no
further claim against Yates Estates.
Website Information
5) Yates Estates aim to ensure that its website is kept up to date and accurate. Whilst to the best of
our knowledge the details relating to any property described in the website were correct at the
time of production, we reserve the right to make modifications to our website at any time. In the
event that unintentional errors, mistakes or omissions occur, we can not accept liability for these
details. Yates Estates cannot accept responsibility for any changes or closures to area amenities
or attractions mentioned in the website.
Holidaymaker Responsibilities
During the period of the holiday, the Holidaymaker undertakes the following:
6(a) That the number of persons using the holiday property will not exceed the number stated on the
booking form. If it does, the owners of Yates Estates can reserve the right to refuse entry to the
property or make the Holidaymaker leave the accommodation before the end of the holiday. In
such an event, Yates Estates shall deem the holiday to be cancelled by the Holidaymaker and the
Holidaymaker shall have no claim against Yates Estates for compensation or reimbursement
whatsoever.
6(b) The property will be used solely for the purpose of a holiday by the Holidaymaker and his/her
party.
6(c) To arrive after the stated arrival time. This will normally be 3 p.m unless advised otherwise. To
vacate the premises by 10 a.m. on the day of departure. We will try to be flexible with these
times where, for example, you have young children and babies. However this is strictly by prior
arrangement with Yates Estates.
6(d) To show due consideration to other parties. If the Holidaymaker abuses the property or causes
harassment, alarm or distress to the caretaker or any third parties (e.g. neighbours), Yates
Estates has the right to ask the Holidaymaker to leave the accommodation before the end of the
holiday. In such instances, Yates Estates will treat the holiday as cancelled by the Holidaymaker
and the Holidaymaker shall have no claim against Yates Estates for compensation or
reimbursement whatsoever.
6(e) To allow the property owner or their representative access to the property at any reasonable time
during the period of the holiday.
6(f) To take good care of the property and all its contents, and to keep it in the same state of repair
and condition as at the commencement of the holiday. Also to ensure that the property is left in
the clean and tidy state in which it was found. The care is to include all furnishings, equipment,
utensils, crockery, linen, fixtures and fittings. Yates Estates reserve the right to impose an
additional charge for any extra cleaning required after the Holidaymaker’s occupancy.
6(g) To report as soon as is practicable to Yates Estates any breakages or damage caused by the
Holidaymaker. To reimburse Yates Estates with the cost of replacements. Yates Estates reserve
the right to make a claim against the Holidaymaker for repair or loss as a result of damage
caused.
6(h) To not smoke inside the property.
6(i) To notify all other members of the Holidaymaker’s party of the terms and conditions.
Pets
7) Pets are not allowed at The Steading. If a Holidaymaker takes a pet to the property, Yates
Estates can refuse to allow the Holidaymaker to enter the property or make the Holidaymaker
leave the accommodation before the end of the holiday. In such instances, Yates Estates will
treat the holiday as cancelled by the Holidaymaker and the Holidaymaker shall have no claim
against Yates Estates for compensation or reimbursement whatsoever.
Complaints
8) Yates Estates endeavours to ensure that our homes are clean and tidy upon arrival of our guests.
However, it is essential that any defect or shortage is reported to us immediately, in order that
the problem can be rectified as quickly as possible. Should any problems arise during your
holiday, we would appreciate being advised immediately.
Limitations of Liability
9) The use of holiday accommodation and any facilities is entirely at the Holidaymaker's own risk.
No liability is accepted for any deaths, sickness or injury or loss or damage to property,
howsoever caused, which may be sustained during the holiday to any member of the party, or any
motor vehicle and its contents or any possessions of the holiday maker.
Mailing List
10) Any data collected during the course of this booking may be kept on computer. If a Holidaymaker
wishes to be removed from Yates Estates mailing list, they should call Yates Estates on 0116
2376453.
